Welcome to the Modulyo platform, operated by David Rozsa, a sole proprietorship (Einzelunternehmen) established in Austria. Please read these Terms of Service (ToS) carefully. By accessing or using the Modulyo website or services, you agree that these terms are binding upon you. If you do not agree, please do not use our services.

'Modulyo' is the trading name / brand of David Rozsa.

1. Trademarks

'Modulyo' is a trademark of David Rozsa. Other trademarks appearing on this website – including but not limited to Stripe, Supabase, Lovable, Google, and others – are the intellectual property of their respective owners. All such names, logos, and brands are used for identification purposes only.

2. Account Usage

By creating an account on the Modulyo website, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Please notify us immediately if you suspect unauthorized access or misuse of your account.

We reserve the right to suspend or terminate access to any user account without prior notice if we detect that any activity violates these Terms, misuses our content, or harms our platform or community, including account sharing or automated/robotic use of the service.

3. Privacy

Your privacy is important to us. Please refer to our Privacy Policy for detailed information on how we collect, use, store, and protect your personal data. By using our services, you accept the practices described in the Privacy Policy.

4. Website Availability

We strive to ensure that Modulyo is always accessible and operational. However, due to the nature of online services, we cannot guarantee uninterrupted access. From time to time, we must perform updates or maintenance, which may cause brief downtime.

5. Limitation of Liability

To the fullest extent permitted by law, Modulyo and David Rozsa shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from the use of or inability to use the website or services. This applies regardless of the legal theory upon which the claim is based.

6. Copyright and Usage

All content, including text, design elements, graphics, and source code, is the intellectual property of David Rozsa or their partners. You may not reproduce, distribute, sell, or republish any material except as expressly permitted. Content you create (notes, project ideas) remains your property.

7. Pricing and Payments

Prices: All prices displayed on the site are final prices in the applicable currency — they are the total amount payable. The operator is a small business under Austrian law (Kleinunternehmer pursuant to § 6 Abs. 1 Z 27 UStG); therefore no value-added tax (VAT) is charged and none is shown separately.

Multi-Currency System and Payment Obligation (Based on Language Setting): The currency and amount payable are displayed based on the language set in the user interface. The payment obligation is based on the amount shown in the displayed currency.

HUF (Hungarian Forint): For Hungarian language interface. Payment is made in HUF.

EUR (Euro): For German or other official European Union language interface. Payment is made in EUR.

USD (US Dollar): For English or any other international language interface. Payment is made in USD.

Local Fees and Taxes: Depending on your bank, currency conversion fees or local transaction charges may apply during payment processing. David Rozsa is not responsible for these fees.

Payment Processing: Payments are securely processed by Stripe.

8. Subscriptions and Digital Services

Modulyo offers subscription services with monthly or annual packages. Subscriptions automatically renew unless you cancel them through the Stripe customer portal.

Free Explorer Plan: New users receive a free Explorer plan with 50 one-time starter credits to explore the service.

Cancellation: You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period and is not refundable.

9. Refunds and Exchanges

Subscription fees are generally non-refundable. Exceptions may only apply if technical issues arise that cannot be resolved and fall within Modulyo's responsibility.

10. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11. Governing Law

These Terms are governed by the laws of Austria, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, you additionally enjoy the protection of the mandatory provisions of the law of your country of residence. Disputes are subject to the jurisdiction of the competent court at the operator's registered seat in Austria, unless mandatory consumer-protection law provides otherwise.

12. AI and Content Usage

Modulyo uses an AI-based mentor (Google Gemini) to generate content and ideas. AI-generated responses are for informational purposes only and do not replace professional or legal advice. You are responsible for verifying the accuracy of AI-generated content and its use. We do not accept liability for the accuracy of AI-generated content.

13. Language Statement

If this document is translated into other languages for convenience, in the event of any inconsistency or legal dispute, the English version shall prevail.

14. Updates

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page. We recommend that you review this page regularly.
